TERMS OF SERVICE
1. AGREEMENT
These terms apply to your download, access or use of Fishing Party games, whether on your computer, on a mobile device, or any other website, device or platform.
These terms also apply to any other services that we may provide in relation to the Games or the Website, such as customer support, social media, community channels and other websites that we may operate from time to time (we refer to all our Games and other services collectively as the "Services" in these terms). These terms are a legal agreement and contain important information about your rights and obligations in relation to our Services.
By registering for an Account or otherwise using the Service, you undertake that you are an adult. For users who are minors, please ensure that your legal guardian has reviewed and agreed to all aspects of these Terms of Service.
By installing, using or otherwise accessing the service, you agree to these terms of service. if you do not agree to these terms of service, please do not install, use or otherwise access the service. Use of the service is void where prohibited.
Please note: in these terms "we", "us" and "our" are references to Fishing Party.
2. UPDATES
Fishing Party reserves the right, at its discretion, to change, update, modify, add or remove portions of these Terms of Service, Privacy Policy and other relevant Fishing Party policies at any time by posting the amended terms on the Fishing Party Service. You will be deemed to have accepted such changes by continuing to use the Service. If at any point you do not agree to any portion of the then-current version of our Terms of Service, the Fishing Party Privacy Policy, or any other Fishing Party policy, rules or codes of conduct relating to your use of the Service, your license to use the Service shall immediately terminate, and you must immediately stop using the Service.
3. GRANT OF A LIMITED LICENSE TO USE THE SERVICE
Subject to your agreement and continuing compliance with these Terms of Service and any other relevant Fishing Party policies, Fishing Party grants you a non-exclusive, non-transferable, non-sublicensable, revocable and limited license to access and use the Service for your own non-commercial entertainment purposes. You agree not to use the Service for any other purpose.If you violate any of these Terms of Service, we reserve the right to terminate your license without notice.
4. ABOUT ACCESSING AND USING OUR SERVICES
The specific game rules, scoring rules, controls and guidelines for each Game can be found within the Game itself. Such rules, scoring rules, controls and guidelines form part of these terms and you agree that you shall comply with them in respect of each individual Game which you choose to access or play.
You are responsible for the internet connection or mobile charges that you may incur for accessing or using our Services. You should ask your mobile operator or internet service provider if you are unsure what these charges will be, before you access or use our Services.
There may be times when our Services or any part of them are not available for technical or maintenance related reasons, whether on a scheduled or unscheduled basis.
Fishing Party does not offer real money gambling or an opportunity to win real money or prizes. Practice or success at social gaming does not imply future success at real money gambling.
5.MINORS; NOT SUITABLE TO USE OUR SERVICES
If you are a minor, you may not create an Account or access the Services. By accessing and using the Services, you declare that you are an adult user. In the case of minors, we recommend that legal guardians increase their supervision of their children to prevent them from becoming addicted to the games and damaging their physical and mental health.
6.CODE OF CONDUCT
You need to comply with the following restrictions in order to use our service：
1) You shall not (or attempt to) purchase, sell, rent or give away your Account, create an Account using a false identity or information, or on behalf of someone other than yourself; You shall not use the Service if you have previously been removed by Fishing Party, or previously been banned from playing any Fishing Party game.
2) You shall use your Account only for non-commercial purposes; You shall not use the Service to advertise, or solicit, or transmit any commercial advertisements, including chain letters, junk or spam e-mail or repetitive or misleading messages to anyone.
3) Not engage in any act that Fishing Party deems to be in conflict with the spirit or intent of the Service or make improper use of Fishing Party's support services.
4) Should not use or take part (directly or indirectly) in the use of cheats, exploits, automation software, bots, hacks, mods or any unauthorized third-party software designed to modify or interfere with the Service, any Fishing Party game or any Fishing Party game experience.
5) Can’t modify or cause to be modified any files that are a part of the Service or any Fishing Party game without Fishing Party's written consent.
6) Should not disrupt, interfere with or otherwise adversely affect the normal flow of the Service or otherwise act in a manner that may negatively affect other users' experience when using the Service or playing Fishing Party's games. This includes win trading and any other kind of manipulation of rankings, taking advantage of errors in the Service to gain an unfair edge over other players and any other act that intentionally abuses or goes against the design of the Service.
7) Should not disrupt, overburden, or aid or assist in the disruption or overburdening of any computer or server ("Server") used to offer or support the Service or any Fishing Party game environment.
8) Should not institute, assist, or become involved in any type of attack, including without limitation distribution of a virus, denial of service attacks upon the Service, or other attempts to disrupt the Service or any other person's use or enjoyment of the Service.
9) Should not attempt to gain unauthorized access to the Service, Accounts registered to others or to the computers, Servers, or networks connected to the Service by any means other than the user interface provided by Fishing Party, including but not limited to, by circumventing or modifying, attempting to circumvent or modify, or encouraging or assisting any other person to circumvent or modify, any security, technology, device, or software that is part of the Service.
10) Should not post any information that is abusive, threatening, obscene, defamatory, libelous, or racially, sexually, religiously, or otherwise objectionable or offensive or engage in ongoing toxic behavior, such as by repeatedly posting information on an unsolicited basis.
11) Post any information that contains nudity, excessive violence, or offensive subject matter or that contains a link to such content.
12) Should not promote information that is false or misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous.
13) Should not attempt to, or harass, abuse, or harm, or advocate or incite harassment, abuse, or harm of another person, group, including Fishing Party employees and customer service representatives.
14) Should not make available through the Service any material or information that infringes any copyright, trademark, patent, trade secret, right of privacy, right of publicity, or other right of any person or entity or impersonates any other person, including without limitation a Fishing Party employee.
15) Should not reverse engineer, decompile, disassemble, decipher or otherwise attempt to derive the source code for any underlying software or other intellectual property used to provide the Service or any Fishing Party game, or to obtain any information from the Service or any Fishing Party game using any method not expressly permitted by Fishing Party.
16) Should not solicit or attempt to solicit Login Information or any other login credentials or personal information from other users of the Service or any Fishing Party game.
17) Should not collect or post anyone's private information, including personally identifiable information (whether in text, image or video form), identification documents, or financial information through the Service.
18) Should not violate the contractual, personal, intellectual property or other rights of any party.
19) Should not engage in the transmission of "junk mail," "chain letters," or unsolicited mass mailing, instant messaging, "spamming".
20) Should not further or promote any criminal activity or enterprise or provide instructional information about illegal activities including, but not limited to making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses.
21) Should not disseminate or promote an illegal or unauthorized copy of another person's copyrighted work, such as providing pirated computer programs or links to pirated work, providing information to circumvent manufacturer-installed copy-protect devices, or providing pirated games or links to any other illegal files.
22) Should not disseminate, transmit, or permit the uploading of viruses, Trojan horses, keyboard loggers, time bombs, adware, spyware, or any other malicious or invasive code or program.
23) You should not participate in anything activities which results or may result in an authorized user of the Services being defrauded out of Virtual Currency or Virtual Goods that the user has earned through authorized game play in the Services.
24) Should not sell the Services or any part thereof, including but not limited, to Virtual Goods or Virtual Currency, user accounts and access to them in exchange for real currency or items of monetary value.
25)Should not undertake any unpermitted commercial activities or sales without our prior written consent.
7. LOGIN INFORMATION AND YOUR ACCOUNT
Accounts
You may be required to select a password for your Account or you may also use other credentials to access the Account ("Login Information"). You shall not share the Account or the Login Information, nor let anyone else access your Account or do anything else that might jeopardize the security of your Account. In the event you become aware of or reasonably suspect any breach of security, including without limitation any loss, theft, or unauthorized disclosure of the Login Information, you must immediately notify Fishing Party and modify your Login Information. You are solely responsible for maintaining the confidentiality of the Login Information, and you will be responsible for all uses of the Login Information, including purchases, whether or not authorized by you. You are responsible for anything that happens through your Account.
Username
Fishing Party reserves the right to remove or reclaim any usernames at any time and for any reason, including but not limited to claims by a third party that a username violates the third party's rights.
Account Termination or limitation
Without limiting our other remedies, we may limit, suspend or terminate the service and user accounts or portions thereof, prohibit access to our games and sites, and their content, services and tools, delay or remove hosted content, and take technical and legal steps to prevent users from accessing the service if we believe that they are creating risk or possible legal liabilities, infringing the intellectual property rights of third parties, or acting inconsistently with the letter or spirit of our terms or policies. You can lose your user name and persona in the service as a result of account termination or limitation, as well as any benefits, privileges, earned items and purchased items associated with your use of the service, and Fishing Party is under no obligation to compensate you for any such losses or results.
Fishing Party reserves the right to terminate any account that has been inactive for 180 days.
Suspension and Termination of Account and Service
Fishing Party reserves the right to stop offering or supporting the Service or a particular game or part of the Service at any time, at which point your license to use the Service or a part thereof will be automatically terminated. In such event, Fishing Party shall not be required to provide refunds, benefits or other compensation to users in connection with such discontinued Service
Termination of your Account can include disabling your access to the Service or any part thereof including any content you submitted or others submitted.
Fishing Party reserves the right to determine what conduct it considers to be in violation of the rules of use or otherwise outside the intent or spirit of these Terms of Service or the Service itself. Fishing Party reserves the right to take action as a result, which may include terminating your Account and prohibiting you from using the Service in whole or in part.
8.OWNERSHIP
Ownership of account
You agree that you shall have no ownership or other property interest in the account, and you agree that all rights in and to the account are and shall forever be owned by and inure to the benefit of Fishing Party.
Virtual Items
Fishing Party owns, has licensed, or otherwise has rights to use all of the content that appears in the Service or in Fishing Party games. Notwithstanding any provision to the contrary herein, you agree that you have no right or title in or to any content that appears in the Service, including without limitation the virtual goods or currency appearing or originating in any Fishing Party game, whether earned in a game or purchased from Fishing Party, or any other attributes associated with an Account or stored on the Service.
Games and Service
All rights, title and interest in and to the Service (including without limitation any games, computer code, themes, objects, characters, character names, stories, dialogue, catch phrases, concepts, artwork, animations, sounds, musical compositions, audio-visual effects, methods of operation, documentation, in-game chat transcripts, character profile information, recordings of games played using a Fishing Party game client, server software) are owned by Fishing Party. Fishing Party reserves all rights, including without limitation, all intellectual property rights or other proprietary rights, in connection with its games and the Service.
9. USER CONTENT
Submission of User Content
"User Content" means any communications, images, sounds, and all the material, data, and information that you upload or transmit through a Fishing Party game client or the Service, or that other users upload or transmit, including without limitation any chat text. By transmitting or submitting any User Content while using the Service, you affirm, represent and warrant that such transmission or submission is
1) accurate and not confidential or misleading;
2) not in violation of any laws, contractual restrictions or other third party rights, and that you have permission from any third party whose personal information or intellectual property is comprised in the User Content;
3) free of viruses, adware, spyware, worms or other malicious code; and
4) you acknowledge and agree that any of your personal information within such content will at all times be processed by Fishing Party in accordance with its Privacy Policy.
Content Screening
Fishing Party assumes no responsibility for the conduct of any user submitting any User Content, and assumes no responsibility for monitoring the Service for inappropriate content or conduct. We do not, and cannot, pre-screen or monitor all User Content. By using the Service, you may be exposed to User Content that is offensive, indecent or otherwise not in line with your expectations. You bear all risks associated with the use of any User Content available in connection with the Service. At our discretion, our representatives or technology may monitor or record your interaction with the Service or communications (including without limitation chat text) when you are using the Service.
By entering into these Terms of Service, you hereby provide your irrevocable consent to such monitoring and recording. You acknowledge and agree that you have no expectation of privacy concerning the transmission of any User Content, including without limitation chat text or voice communications.
Fishing Party reserves the right in its sole discretion to review, monitor, prohibit, edit, delete, disable access to or otherwise make unavailable any User Content (including without limitation your User Content) without notice for any reason or for no reason at any time. If at any time Fishing Party chooses, in its sole discretion, to monitor the Service, Fishing Party nonetheless assumes no responsibility for User Content and assumes no obligation to modify or remove any inappropriate User Content.
10.CONTENT RIGHTS
The Service may include various forums, blogs and chat features where you can post User Content, including your observations and comments on designated topics. Fishing Party cannot guarantee that other members will not use the ideas and information that you share. Therefore, if you have an idea or information that you would like to keep confidential or don't want others to use, do not post it on the Service. Fishing Party shall have no responsibility to evaluate, use or compensate you for any ideas or information you may choose to submit.
You are solely responsible for the information that you post on, through or in connection with the Service and that you provide to others. Fishing Party may reject, refuse to post or delete any User Content for any or no reason, including, but not limited to, User Content that in the sole judgment of Fishing Party violates these Terms of Service.
You may not upload or post any Content on the Services that infringes the copyright, trademark or other intellectual property rights of a third party nor may you upload Content that violates any third party's right of privacy or right of publicity. Fishing Party may, without prior notice to you and in its sole judgment, remove Content that may infringe the intellectual property or other rights of a third party.
If you are a repeat infringer of Fishing Party's or a third party's intellectual property or other rights, Fishing Party may terminate your account without notice to you. If your account is terminated, you are not entitled to a refund for any fees you have paid, and you will lose access to all Virtual Goods, Virtual Currency and any other benefits of your account.
11.USER INTERACTIONS
You are solely responsible for your interactions with other users of the Service and any other parties with whom you interact through the Service orFishing Party games. Fishing Party reserves the right, but has no obligation, to become involved in any way with these disputes. You will fully cooperate with Fishing Party to investigate any suspected unlawful, fraudulent or improper activity, including, without limitation, granting Fishing Party access to any password-protected portions of your Account.
If you have a dispute with one or more users, you release us (and our officers, directors, agents, subsidiaries, joint ventures and employees) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes.
12. PURCHASES
The Services may include virtual, in-game currency ("Virtual Currency"), such as coins, cash, or points, that may be purchased with “real” money through transactions with one of our authorized payment vendors. In turn, Virtual Currency may be used to purchase virtual, in-game digital items or other in-game services ("Virtual Goods").
You are therefore not permitted to trade, sell or attempt to sell in-game items or currency for "real" money, or exchange those items or currency for value of any kind outside of a game, without Fishing Party’s written permission. Any such transfer or attempted transfer is prohibited and void, and will subject your account to termination.
You are only allowed to purchase Virtual Items from us or our authorised partners through the Service, and not in any other way.
Fishing Party may manage, regulate, control, modify or eliminate Virtual Items or Merchandise at any time, with or without notice. Fishing Party shall have no liability to you or any third party in the event that Fishing Party exercises any such rights.
The transfer of Virtual Items and Merchandise is prohibited except where expressly authorized in the Service. You shall not sell, purchase, redeem or otherwise transfer Virtual Items or Merchandise to any person or entity or attempt any of the aforesaid, including but not limited to Fishing Party, another user or any third party.
13.REFUND POLICIES
European Union rules
If you reside in the European Union, by law you have the right to withdraw from a purchase within fourteen (14) days, commencing on the day when you receive your purchase (“cooling-off period”). If you have not used the Virtual Currency or items you purchased within the cooling-off period and you wish to obtain a refund, please immediately advise Fishing Party (or the applicable Third Party Service) so that a refund can be issued within 30 days.
If your use of the Services or game purchase is subject to any type of use or sales tax, then Fishing Party may also charge you for those fees.
Virtual Currency Offered by Third Parties
Please be aware that if you purchase Facebook Credits, Google Play Credit, or make a purchase via other payment credit offered by the applicable Third Party Service, you are agreeing to that service’s payment terms and Fishing Party is not a party to the transaction. You agree to pay all fees and applicable taxes incurred by you or anyone using an account registered to you. You will also be subject to that Third Party Service’s refund policies.
14. DISCLAIMER OF WARRANTIES
The services are provided on an "as is" and "as available" basis. Fishing Party makes no representations or warranties of any kind, express or implied, as to the operation of the services or the information, content, materials, or products included on the service or provided via Fishing Party. You expressly agree that your use of the services is at your sole risk and that you will be solely responsible for any damage to your computer system or loss of data that results from your using the services.
To the full extent permissible by applicable law, Fishing Party disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. without limiting the foregoing, neither Fishing Party nor its affiliates or subsidiaries, or any of their directors, employees, agents, attorneys, third-party content providers, distributors, licensees or licensors warrant that the service will be uninterrupted or error-free.
15.LIMITATIONS; WAIVERS OF LIABILITY
To the maximum extent permitted by law, Fishing Party shall not be liable to you for any indirect, incidental, consequential, special, punitive or other similar damages, including but not limited to loss of revenues, lost profits, lost data or business interruption or other intangible losses (however such losses are qualified), arising out of or relating in any way to these terms of service or the service itself, whether based on contract, tort or any other legal theory, and whether or not Fishing Party has been advised of the possibility of such damages.
Nothing in these terms of service shall affect the statutory rights of any consumer or exclude or restrict any liabilities.
You agree to compensate us, according to law, for all losses, harm, claims and expenses that may arise from any breach of these terms by you.
16. DISPUTE RESOLUTION AND LAW
If a dispute arises between you and Fishing Party, we strongly encourage you to first contact us directly by customer support in game to seek a resolution. If you are a resident of the United States, these Terms of Service and any dispute arising out of or related to it or Privacy Policy or the Service shall be governed in all respects by California law, without regard to conflict of law provisions. If you are a resident outside of the United States, you agree that all disputes between you and Fishing Party shall be governed by the laws of China, without regard to conflict of law provisions. You agree that any claim or dispute you may have against Fishing Party must be resolved exclusively by a court located in China.
17. SEVERABILITY
You and Fishing Party agree that if any portion of these Terms of Service or of the Fishing Party Privacy Policy is found illegal or unenforceable, in whole or in part by any court of competent jurisdiction, such provision shall, as to such jurisdiction, be ineffective solely to the extent of such determination of invalidity or unenforceability without affecting the validity or enforceability thereof in any other manner or jurisdiction and without affecting the remaining provisions of the terms, which shall continue to be in full force and effect.
18. ADVERTISEMENTS
Fishing Party may provide links on the Services to third party websites or vendors who may invite you to participate in a promotional offer in return for receiving additional Services, Virtual Goods or Virtual Currency. Any charges or obligations you incur in your dealings with these third parties are your responsibility. Fishing Party makes no representation or warranty regarding any content, goods or services provided by any third party (even if linked from our Services), and will not be liable for any claim relating to any third party content, goods or services. Fishing Party is not responsible for such third party content, business practices or privacy policies, or for the collection, use or disclosure of any information those sites may collect.
19.EQUITABLE REMEDIES
You acknowledge that the rights granted and obligations made under these Terms of Service to Fishing Party are of a unique and irreplaceable nature, the loss of which shall irreparably harm Fishing Party and which cannot be replaced by monetary damages alone so that Fishing Party shall be entitled to injunctive or other equitable relief (without the obligations of posting any bond or surety or proof of damages) in the event of any breach or anticipatory breach by you.
You irrevocably waive all rights to seek injunctive or other equitable relief, or to enjoin or restrain the operation of the Service or any Fishing Party game, exploitation of any advertising or other materials issued in connection therewith, or exploitation of the Service or any content or other material used or displayed through the Service.
20.SUPPLEMENTAL POLICIES
Fishing Party may publish additional policies related to specific services such as forums, promotions, contests or loyalty programs. For example, before participating in our game forums, you should read and must abide by the Forum Rules applicable to the Service’s community. Your right to use such services is subject to those specific policies and these Terms of Service.
21.FORCE MAJEURE
Fishing Party shall not be liable for any delay or failure to perform resulting from causes outside the reasonable control of Fishing Party, including without limitation any failure to perform hereunder due to unforeseen circumstances or cause beyond Fishing Party's control such as acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor or materials.
22.NO WAIVER
Our failure to exercise or enforce any of our rights under these terms does not waive our right to enforce such right. Any waiver of such rights shall only be effective if it is in writing and signed by us.
23.ASSIGNMENT
Fishing Party may assign or delegate these Terms of Service or the Fishing Party Privacy Policy, in whole or in part, to any person or entity at any time with or without your consent. You may not assign or delegate any rights or obligations under the Terms of Service or Privacy Policy without Fishing Party's prior written consent, and any unauthorized assignment and delegation by you is ineffective.
24.ENTIRE AGREEMENT
These Terms of Service, any supplemental policies and any documents expressly incorporated by reference herein (including the Fishing Party Privacy Policy), contain the entire understanding of you and Fishing Party, and supersede all prior understandings of the parties hereto relating to the subject matter hereof, whether electronic, oral or written, or whether established by custom, practice, policy or precedent, between you and us with respect to the Service.

3）不得从事任何Fishing Party认为与服务宗旨或意图相违背的行为，或者任何不当使用Fishing Party所支持服务的行为。
4）不得使用或部分使用（直接或间接）作弊手段、滥用手段、自动化软件、机器人程序、黑客、游戏插件或任何未经许可的第三方软件去修改或干扰服务、Fishing Party游戏或Fishing Party游戏体验。
5）未经Fishing Party明确书面同意，不得修改或引发修改属于服务或任何Fishing Party游戏部分的任何文件。
6）在使用服务或玩Fishing Party游戏时，不得扰乱、干扰或以其他方式影响服务的正常流程，或者以其他方式对其他用户体验产生不良影响。其中包括胜负交易以及任何其他形式的排名操控、利用服务中的漏洞来获得对其他玩家不公平的优势以及任何故意滥用或违反服务设计的其他行为。
7）不得扰乱、超负荷运转，以及使为服务或游戏环境提供支持的电脑或服务器处于干扰或超负荷状态的行为。
8）不得实施、协助或参与任何形式的攻击行为，包括但不限于病毒传播、拒绝服务攻击，或其他企图扰乱服务或任何其他人对服务的使用或享用的行为。
9）不得企图通过Fishing Party提供的用户界面以外的未经授权的访问方式访问服务、他人帐户、计算机、服务器或连接到服务的网络，包括但不限于逃避或修改，试图逃避或修改，或者鼓励或协助他人逃避或修改任何属于服务一部分的安全设置、技术、设备或软件。
10）不得发布任何辱骂、威胁、淫秽、中伤、诽谤，或者在种族、性、宗教或其他方面具有侮辱性或攻击性的信息，或者持续做出有害行为，例如未经同意重复发布相同信息（刷屏）。
11）不得发布任何含有裸露、暴力或攻击性主题的信息，或包含上述内容信息的链接。
12）不得宣传虚假信息、误导性信息，不得宣传非法活动，不得出现辱骂，威胁，淫秽，诽谤的行为。
13）不得实施或试图实施骚扰、辱骂或伤害，提倡或煽动骚扰、辱骂或伤害他人、集体的行为，包括Fishing Party的员工和客户服务代表。
14）不得通过任何服务公开侵犯他人或实体的著作权、商标权、专利权、商业秘密、隐私权、出版权或其他权利的材料或信息，或者假冒任何其他人，包括但不限于Fishing Party的员工。
15）不得实施反向工程、反编译、拆解、破译或任何以其他方式试图取得用于提供服务或Fishing Party游戏底层软件或其他知识产权源代码的行为，或者以任何未经Fishing Party明确许可从服务或Fishing Party游戏中获取任何信息。
16）不得通过任何服务征集或试图通过服务向Fishing Party用户征集登录信息或其他登录凭证或个人信息行为。
17）不得收集或发布任何人的私人信息，包括个人可识别信息（无论是文字、图像还是视频形式）、身份证明文件或者财务信息。
18）不得违反合同，个人，知识产权或任何一方的其他权利。
19）不得从事“垃圾邮件”，“连锁信”或未经请求群发邮件，即时消息。
20）不得深化或促进任何犯罪活动或企业或提供有关非法活动的说明信息，包括但不限于制造或购买非法武器，侵犯他人隐私，或提供或制造计算机病毒。
21）不得传播或宣传他人受版权保护的非法或未经授权副本，例如提供盗版计算机程序或盗版作品链接，提供信息以规避制造商安装的复制保护设备，或提供盗版游戏或链接到任何其他非法文件。
22）不得传播，传输或允许上传病毒，特洛伊木马，键盘记录器，定时炸弹，广告软件，间谍软件或任何其他恶意或侵入性代码或程序。
23）导致或可能导致授权用户被授权游戏中的虚拟货币或虚拟商品欺诈。
24）不得出售服务或其中的某部分，包括但不限于虚拟商品或虚拟货币，用户帐户和访问它们以换取真实货币或货币价值物品。
25）未经我们事先书面同意，不得承担任何未经许可的商业活动或销售。
7.登录信息和您的帐户
账户
您需要为自己的帐户设置一个密码或使用其他凭证来访问帐户（"登录信息"）。您不得分享您的帐户或登录信息，也不得让他人登录您的帐户或者做出任何可能威胁您帐户安全的行为。如果您得知或者有合理理由怀疑存在安全威胁，包括但不限于登录信息的丢失、被盗或未经授权被公开，您必须立即通知Fishing Party并修改您的登录信息。您须对登录信息的持续保密性独自承担责任，并对登录信息的所有使用行为负责，包括但不限于购买行为（不论是否得到您的授权）。您对通过您帐户发生的任何事宜负责。
账户名
Fishing Party保留随时以任何理由删除或收回用户名的权利，包括但不限于第三方申诉用户名侵犯了第三方的权利。
禁号与删号
在不限制其他补救措施的情况下，如果我们认为有风险或有潜在法律责任或可能侵犯第三方的知识产权，或者与我们的条款或政策文字或精神不一致时，我们会采取技术和法律步骤阻止用户访问服务：比如我们可能限制、暂停、终止服务或帐户或其中的部分内容，也有可能禁止您访问我们的游戏、网站及其内容、服务和工具，延迟或删除托管内容。由于帐户被终止或限制，您可能会丢失服务中的用户名和角色，以及与您使用服务相关的福利，特权，获得的物品和购买的物品，Fishing Party没有义务赔偿你这些损失。
Fishing Party有权终止任何连续180天不使用的帐户。
对帐户和服务的中断和终止
Fishing Party有权在任何时候对某个游戏或某项服务停止提供支持服务，此时，对使用许可的全部或部分内容将自动终止。在此情况下，Fishing Party不因此类服务停止而承担任何向用户退款、返还利益或赔偿损失的义务。
对您的帐户的终止措施包括限制用户使用全部或部分服务的权限，其中包括您或他人上传的内容。
Fishing Party保留权利来认定相关行为是否违反使用规则或超出服务条款或服务本身的宗旨和精神。Fishing Party保留权利来据此采取相关措施，包括终止您的帐户和禁止您使用全部或部分服务。
8．所有权
账户所有权
您同意对帐户不享有任何所有权或其他财产权利，并且您同意与帐户相关的所有权利均由Fishing Party享有。
虚拟物品
Fishing Party享有在服务和Fishing Party游戏中出现的全部内容的所有权，有权使用在服务和Fishing Party游戏中出现的全部内容。即使本条款存在任何相反的规定，您同意，您对服务中出现的任何内容没有所有权或任何其他权利，包括但不限于您从Fishing Party购买或从游戏中赚得的虚拟商品或货币，以及任何其他帐户属性或服务中的特权。
游戏和服务
与服务相关的一切权利、所有权和利益（包括但不限于游戏、计算机代码、主题、物体、人物、人物的名字、故事、对话、短语、概念、图画、动画、声音、音乐作品、视听效果、操作方法、文档，游戏内聊天记录，角色简介信息，使用Fishing Party游戏客户端玩游戏的记录，以及服务器软件）由Fishing Party所有。Fishing Party保留与游戏和服务相关的所有权利，包括但不限于知识产权和其他专有权利。
9.用户内容
用户内容提交
“用户内容”指您本人通过Fishing Party游戏客户端或服务上传，或由其他用户上传的包括聊天文本在内的通讯、图像、声音以及所有资料、数据和信息。在使用服务的过程中传输或提交用户内容时，您确认、承诺并保证该传输或提交行为:
1）涉及的信息准确且不得为保密或误导性信息；
2）不违反任何法律规定、合同义务，且不侵犯其他第三方权利，如果在用户内容中包含第三方的个人信息或知识产权时，您应征得该第三方的同意；
3）涉及的内容没有病毒、广告软件、间谍软件、蠕虫和其他恶意代码；以及
4）您确认并同意Fishing Party将根据隐私保护政策在任何时候对此类内容中包含的您的个人信息进行处理。
内容审查
用户提交的任何内容Fishing Party皆不承担任何责任，亦没有责任对用户的不当内容或行为进行监控。我们不对也不能对所有的用户内容进行事前审查或监控。使用服务，您可能接触到带有攻击性的、不适当或与您的预期不符的用户内容，此类风险您需自行承担。我们有权通过工作人员或技术手段监控或记录您与服务的交互过程，或您在使用服务过程中产生的通讯信息（包括但不限于聊天文本）。
本服务条款一经接受，您即不可撤销地同意并接受上述监控和记录。您确认并同意上传的任何内容不涉及隐私，包括但不限于聊天文本或语音信息。
Fishing Party有权不经通知，自行决定审阅、监控、阻止、编辑、删除、禁用或以其它方式禁止访问用户内容（包括但不限于您的用户内容）。Fishing Party在任何时候有权自行选择对服务的监督，Fishing Party对用户内容不承担任何责任，并且没有义务修改或删除任何不适当的用户内容。
10.内容权利
服务可能包括可以发布用户内容的不同形式的论坛、博客和聊天功能，包括您对特定主题的观点和评论。Fishing Party无法保证其他成员对您分享的观点和信息不做任何使用。因此，如果您希望对某些观点和信息进行保密，或不希望其他人使用，请不要在服务上发布。Fishing Party无义务对您上传的任何观点和信息进行评价或使用，也不就您可能选择发布的任何观点或信息向您承担任何赔偿责任。
您对于通过服务或与服务相关的方式发布的信息以及您向他人提供的信息独自承担责任。Fishing Party有权以任何理由或无理由拒绝、拒绝发布或者删除任何用户信息，包括但不限于经Fishing Party单独认定违反本服务条款的用户内容。
您不得在服务上传或发布任何侵犯第三方版权，商标或其他知识产权的内容，也不得上传违反任何第三方隐私权或公开权的内容。Fishing Party可能在未事先通知您且自行判断的情况下删除可能侵犯第三方知识产权或其他权利的内容。
如果您是Fishing Party或第三方知识产权或其他权利的侵权者，Fishing Party可能会在不通知您的情况下终止您的帐户。如果您的帐户被终止，您无权获得已支付的任何费用的退款，并且您将无法访问所有虚拟商品，虚拟货币以及您帐户的任何其他权益。
11.用户交互
您与其他用户以及您通过服务或Fishing Party游戏中其他用户之间进行的互动由您个人独自承担全部责任。Fishing Party保留权利，但没有义务以任何方式参与这些争议。您应全力配合Fishing Party调查任何涉嫌违法、欺诈或不当行为，包括但不限于允许Fishing Party访问您设有密码保护的帐户。
如果您与一名或多名用户之间发生纠纷，您免除我们（包括我们的管理人员、董事、代理、子公司、合资企业和员工）受到此类纠纷产生或与此类纠纷相关的各种已知和未知的及各种类型和性质的主张、请求和索赔（实际损害和间接损害）。
12. 购买
购买服务可以包括虚拟的游戏内货币（“虚拟货币”），例如金币，现金或积分，它们可以通过由我们授权的支付供应商以“真实”货币购买。反过来，虚拟货币可用于购买虚拟的游戏内数字物品或其他游戏内服务（“虚拟商品”）。
未经Fishing Party的书面许可，您不得交易，出售或试图出售游戏内物品或货币去换取真钱，同时兑换这些商品或货币以换取游戏外的任何价值性实物也是不被允许的。任何此类转让或试图性转让均被禁止且无效，同时这将使您的帐户终止。
您只可以通过我们或我们授权的官方合作伙伴来购买虚拟货币，不得通过任何其他途径购买！
Fishing Party任何时候无论是否发出通知皆可管理、规范、控制、修改或者删除虚拟物品或商品。Fishing Party在行使相关权利时不对您或任何第三方承担任何责任。
除在服务中有明确授权外，虚拟物品和商品的转让是禁止的。您无权向任何个人或实体出售、购买、兑换或以其它方式转让虚拟物品或商品或尝试任何此类行为，包括向Fishing Party、其他用户或者任何第三方。
13．退款政策
欧盟规则
如果您居住在欧盟，根据法律，您有权在购买日起十四（14）天内提出退款（“冷静期”）。如果您在冷静期内尚未使用虚拟货币或所购物品并希望获得退款，请立即通知Fishing Party（或适用的第三方服务），以便在30天内发出退款。
如果您对服务的使用或游戏内的购买涉及到任何类型的使用或税费，那么Fishing Party也会向您收取这些费用。
第三方提供的虚拟货币
请注意，如果您购买Facebook Credits，Google Play Credit或通过第三方服务提供的其他付款方式进行购买，即表示您同意该服务的付款条款，而Fishing Party不是该交易的一方。您同意支付您或使用您注册帐户的人所产生的所有费用和适用税费。您还将受到第三方服务的退款政策的约束。
14．免责说明
服务按“原样”和“现有”基础提供。对于运营或服务中包含的或通过FISHING PARTY提供的信息，内容，材料或产品，FISHING PARTY不做任何明示或暗示的陈述或保证。您明确同意，您自行承担使用服务的风险，并且您将对因使用服务而对您的计算机系统造成的任何损害或数据丢失承担全部责任。
在适用法律允许的最大范围内，Fishing Party不承担任何明示或暗示的保证，包括但不限于适销性和特定用途适用性的暗示保证。 在不限制前述规定的前提下，Fishing Party及其附属公司或子公司，或其任何董事，员工，代理商，律师，第三方内容提供商，分销商，许可证持有者或许可方均不保证该服务不会中断或没有错误。
15．限制; 豁免责任
在法律允许的最大范围内，Fishing Party不向用户承担与本条款相关的任何间接的、偶然的、从属的、特殊的、惩罚性的或其他类似的赔偿责任，包括但不限于收入损失、利润损失、数据丢失或商业中断或其他无形损失（不论如何定性该等损失），不论该损失是基于合同、侵权或其他法律原理产生的，且不论Fishing Party是否被告知损害赔偿的可能性。
本服务条款中的任何内容均不会影响消费者的法定权利，亦不会排除或限制任何责任。
您同意根据法律为因您违规造成的损失、伤害、索赔和花费对我们进行赔偿。
16．争议解决和法律适用
如果您和Fishing Party之间发生任何争议，我们建议您首先直接与我们取得联系，并且通过我们游戏内的客服工作人员寻求纠纷解决的方式。如果您是美国居民，本服务条款以及因本条款和隐私保护政策和服务而产生的任何争议适用加州法律，不考虑冲突法律规定。如果您是美国境外的居民，您和Fishing Party之间的任何纠纷适用中国法律，不考虑冲突法律规定。您同意并接受您和Fishing Party之间发生的任何索赔或争议受中华人民共和国法院的排他管辖。
17．可分割性
您和Fishing Party同意，如果本服务条款或Fishing Party隐私政策的任何条款的全部或部分被有管辖权的法院认定为违法或不可执行，该条款仅在该司法辖区内，且在被认定无效或不可执行的范围内没有法律效力，但是不影响该条款在其他司法辖区的法律效力，且该条款其他部分的法律效力不受影响。
18．与第三方网站的链接
Fishing Party可能会向第三方网站或供应商提供服务链接，这些网站或供应商可能会邀请您参与促销优惠，以换取其他服务，虚拟商品或虚拟货币。您在与这些第三方打交道时产生的任何费用或义务是您的责任。Fishing Party对任何第三方提供的任何内容，商品或服务不作任何陈述或保证（即使与我们的服务相关联），也不对任何第三方内容，商品或服务的任何索赔负责。Fishing Party不对此类第三方内容，商业惯例或隐私政策负责，也不对这些网站可能收集的任何信息的收集，使用或披露负责
19．衡平救济
请知悉，在Fishing Party的服务条款下享有的权利和承担的义务是独特的、不可替代的，由于您的违约行为或预期违约行为导致的任何损失都会对Fishing Party造成无法补救的损害，也不能仅通过金钱赔偿而弥补相应损失。因此，Fishing Party享有惩罚性救济或其他衡平救济的权利（没有提供保证、担保或证据的义务）。
您不可撤销地放弃一切寻求禁令或其他公平救济的权利，或禁止或限制本服务或Fishing Party游戏的运行，或利用与之相关的任何广告或其他材料，或利用本服务或通过本服务显示其他内容和资料。

Fishing Party可能会发布与特定服务相关的其他政策，例如论坛，促销，竞赛或忠诚度计划。例如，在参与我们的游戏论坛之前，您应该阅读并且必须遵守适用于该服务社区的论坛规则。您使用此类服务的权利受这些特定政策和本服务条款的约束。
21．不可抗力
Fishing Party对超出其控制范围所导致的延迟或未能履行的义务不承担任何责任，包括但不限于因不能预见的或超出其控制范围的原因，例如天灾、战争、恐怖活动、骚乱、禁运、民事或军事当局行为、火灾、水灾、事故、罢工、交通运输设施短缺、燃料短缺、能源短缺、劳动力短缺和原料短缺。
22．不弃权
如果我们未能行使或执行此类条款中的某些权利，并不表示我们放弃行使此类权利。任何此类弃权仅在我们出具书面说明和签署的情况下才有效。
23．转让
Fishing Party有权随时将本服务条款或Fishing Party隐私保护政策的全部或部分转让或委托给其他个人或实体，不论是否经过您的同意。未经Fishing Party的事先书面同意，您不得将本服务条款或隐私保护政策项下的任何权利或义务转让或委托给其他个人或实体。您任何未经授权的转让或委托无法律效力。
24．完整协议
本服务条款、任何补充政策和通过援引并入的任何文件（包括Fishing Party隐私保护政策），包含了您和Fishing Party之间的全部共识，并且替代之前双方对本条款内容的全部共识，不论这些我们之间关于服务的共识是通过电子形式、口头或书面形式，或者根据交易习惯、惯例、政策或先例确立。
